Terms and conditions of sale
Preamble
Welcome to Hectolitre. These General Terms and Conditions of Sale (hereinafter "GTC") govern the contractual relationship between SAS HECTO BROS (brand "Hectolitre") and any adult individual (hereinafter the "Customer") making a purchase on the website (hereinafter the "Site").
Any order placed on the Site implies the Customer's unreserved acceptance of these GTC.

Article 2 — Purpose and Scope
The purpose of these GTC is to define the conditions under which Hectolitre offers for sale and delivers products, mainly wines and related accessories, to any Customer making a purchase on the Site.
The GTC apply to all distance sales concluded between Hectolitre and the Customer in metropolitan France. Delivery to Corsica, overseas departments and territories, or abroad is subject to specific conditions detailed in Article 8.
Any order placed implies full and unreserved acceptance of the GTC in force on the date of the order.
Article 3 — Information on the Sale of Alcoholic Beverages
3.1 Health Warning (Loi Évin)
In accordance with articles L. 3323-2 et seq. of the French Public Health Code:
Alcohol abuse is dangerous for your health. Consume in moderation.
3.2 Prohibition of Sale to Minors
In accordance with article L. 3342-1 of the French Public Health Code, the sale of alcohol to minors under 18 years of age is strictly prohibited.
By placing an order on the Site, the Customer declares on their honor:
- to be 18 years of age or older on the date of the order;
- not to order products for a minor.
Hectolitre reserves the right, in case of doubt, to refuse an order or to request proof of age before shipment. False declaration of age engages the Customer's criminal liability.
3.3 Sale of Breathalyzers
In accordance with article 100 of law no. 2019-1428 of December 24, 2019, on the orientation of mobilities, and decree no. 2021-735 of June 8, 2021, Hectolitre offers for sale, permanently and visibly on the payment page, breathalyzers for individual testing of exhaled alcohol levels.
3.4 Responsible Consumption
Hectolitre is committed to promoting responsible and moderate consumption. The Customer is invited to consult the official prevention website: www.alcool-info-service.fr or to call 0 980 980 930 (non-surcharged call).
Article 4 — Products
4.1 Description
The products offered for sale are presented with their essential characteristics: name, vintage, region, grape variety, alcohol content, capacity, price.
Photographs and illustrations are provided for information purposes only and do not contractually bind Hectolitre. As wine is a living product, minor variations in color, hue, or taste may be observed between two bottles of the same vintage.
4.2 Availability
Product and price offers are valid as long as they are visible on the Site and within the limits of available stock. In the event of unavailability of a product after the order has been placed, the Customer will be informed by email and may opt for a refund or an equivalent product.
4.3 Vintages and Cuvée Change
Hectolitre reserves the right to replace an out-of-stock vintage with the next vintage, unless the Customer expressly objects at the time of the order.
Article 5 — Prices
Prices are indicated in euros, all taxes included (TTC), including applicable French VAT. Delivery costs are indicated separately before order validation.
Hectolitre reserves the right to modify its prices at any time. Products are invoiced at the rate in force at the time the order is registered.
Article 6 — Order
6.1 Placing an Order
To place an order, the Customer:
- Selects the desired products and adds them to the cart;
- Checks the contents of the cart and the total;
- Enters their delivery and billing details;
- Chooses their delivery method;
- Must check the "I certify that I am 18 years old" and "I accept the GTC" boxes;
- Proceeds to payment.
A confirmation email summarizing the order is sent to the Customer at the address provided.
6.2 Validation and Refusal
Hectolitre reserves the right to refuse or cancel any order:
- in case of payment default;
- in case of doubt about the Customer's age;
- in case of a previous dispute;
- in case of a clearly abnormal order (quantity, frequency, suspicious delivery address).
6.3 Retention of Proof
The computerized records kept in Hectolitre's systems will be considered as proof of communications, orders, and payments between the parties.
Article 7 — Payment
7.1 Payment Methods
Payment is made at the time of order by:
- bank card (CB, Visa, Mastercard, American Express);
7.2 Security
Transactions are secured by the Shopify Payments provider. Banking data is encrypted (SSL/TLS protocol) and is never transmitted in clear text through Hectolitre's servers.
7.3 Invoicing
An invoice is issued for each order and sent by email to the Customer. A copy can be requested at any time.
7.4 Late Payment
In case of late payment, Hectolitre reserves the right to suspend the order and to charge late payment penalties at the legal rate in force.
Article 8 — Delivery
8.1 Delivery Areas
Hectolitre delivers to metropolitan France and Corsica (a surcharge applies for Corsica, indicated at the time of order). Deliveries to overseas departments and territories and internationally are not available at this time. Deliveries to the European Union may be offered occasionally, under the conditions and rates indicated when ordering.
8.2 Deadlines
Orders are prepared within 1 to 3 working days after receipt of payment. The delivery time is then 1 to 3 working days depending on the carrier and the chosen method: next day delivery before 1 PM with Chronopost, within 2 to 3 working days with Colissimo. These deadlines are understood after shipment, subject to carrier constraints.
The indicated deadlines are for information purposes only. No delay can lead to the cancellation of the order or the payment of damages, unless the delay exceeds 30 days after confirmation of the order, in accordance with article L. 216-1 of the French Consumer Code.
8.3 Carriers and Rates
The carriers used are Colissimo (La Poste) and Chronopost. Two delivery methods are offered: home delivery (delivery against signature) and delivery to a relay point. The rates, indicated at the time of choosing the delivery method on the Site, depend on the number of bottles ordered:
- Home delivery: €10 (1 to 2 bottles), €13.50 (3 to 5 bottles), €15 (6 to 11 bottles);
- Relay point: €6.90 (1 to 2 bottles), €9.90 (3 to 5 bottles), €11.90 (6 to 11 bottles);
- Free shipping from 12 bottles (a full case), both for home delivery and relay point delivery.
A surcharge applies for deliveries to Corsica. When relay point delivery is chosen, the relay point is selected by the Customer after validating their order.
8.4 Verification upon Receipt
As wine is a fragile product, the Customer is required to check the condition of the package upon receipt, in the presence of the delivery person.
In case of a damaged package (dented carton, broken bottles, traces of liquid), the Customer must:
- Refuse the package or make precise and detailed reservations on the delivery note (mentions such as "subject to unpacking" are not sufficient);
- Notify Hectolitre by email within a maximum of 3 days after receipt, attaching photos of the package and damaged products.
After this period, or in the absence of precise reservations on the delivery note, no claim for breakage during transport will be taken into account.
8.5 Delivery to Adults
Delivery is made to an adult. The carrier may request an identity document upon delivery of the package. In case of absence and delivery to a third party, the Customer guarantees that this person is an adult.
Article 9 — Right of Withdrawal
9.1 Principle
In accordance with articles L. 221-18 et seq. of the French Consumer Code, the Customer has a period of 14 days from receipt of their order to exercise their right of withdrawal, without having to give reasons or pay penalties.
9.2 Exclusions
The right of withdrawal does not apply to unsealed products. In accordance with article L. 221-28 of the French Consumer Code, the following cannot be returned:
- bottles that have been opened, unsealed, or have suffered an alteration to their capsule, cork, or labeling;
- customized products or those made to specific order.
9.3 Modalities
To exercise their right of withdrawal, the Customer notifies their decision by email to contact@hectolitre.fr
The Customer returns the products in their original packaging, intact, sealed, and accompanied by the invoice, at their own expense, within a maximum period of 14 days after notification.
9.4 Refund
The refund will be made within a maximum of 14 days after receipt of the products by Hectolitre, using the same payment method as that used for the order, unless otherwise agreed by the Customer.
Article 10 — Legal Guarantees
10.1 Legal Guarantee of Conformity
In accordance with articles L. 217-3 et seq. of the French Consumer Code, Hectolitre is responsible for defects in conformity existing at the time of delivery of the products for a period of 2 years from delivery.
10.2 Guarantee against Hidden Defects
In accordance with articles 1641 et seq. of the French Civil Code, the Customer may decide to implement the guarantee against hidden defects of the sold item, within a period of 2 years from the discovery of the defect.
10.3 Implementation
For any implementation of the legal guarantees, the Customer is invited to contact Hectolitre at contact@hectolitre.fr by attaching the invoice, photos, and a description of the defect.
Article 11 — Intellectual Property
All content present on the Site (texts, images, logos, brands, labels, designs, illustrations, photographs, videos) is the exclusive property of Hectolitre or its partners, and is protected by current intellectual property laws.
Any reproduction, representation, modification, publication, transmission or exploitation, total or partial, of these elements, without prior written authorization from Hectolitre, is strictly prohibited and constitutes an act of infringement punishable by articles L. 335-2 et seq. of the French Intellectual Property Code.
Article 12 — Personal Data Protection (GDPR)
12.1 Data Controller
The data controller for the personal data collected is SAS HECTO BROS, whose contact details are provided in Article 1.
12.2 Data Collected and Purposes
The data collected (surname, first name, address, email, telephone, order data) are used to:
- process and ship orders;
- provide customer service and manage disputes;
- send commercial communications (newsletter, offers) subject to the Customer's consent;
- meet legal obligations (invoicing, accounting).
12.3 Legal Basis
Processing is based on:
- the performance of the sales contract (order, delivery, invoicing);
- consent (marketing communications);
- legal obligations (retention of invoices)
12.4 Recipients
Data may be communicated to:
- Hectolitre's technical service providers (Shopify host, payment provider, carrier);
- legal authorities upon request.
No data is transferred or rented to third parties for commercial purposes without the Customer's explicit consent.
12.5 Retention Period
- Order data: 10 years (accounting and tax obligation);
- Customer account data: until the account is deleted by the Customer or after 3 years of inactivity;
- Marketing data: until consent is withdrawn.
12.6 Customer Rights
In accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act (Loi Informatique et Libertés), the Customer has the following rights: access, rectification, erasure, opposition, restriction, portability, withdrawal of consent.

12.7 Cookies
The Site uses cookies. The management procedures are detailed in the Cookie Management Policy, accessible from the consent banner.
Article 13 — Force Majeure
Hectolitre cannot be held responsible for any delay or non-performance of its obligations resulting from a case of force majeure as defined by French case law: natural disaster, strike, embargo, accident, blocking of transport or supply means, pandemic, governmental decision or any other unforeseeable and irresistible event.
Article 14 — Dispute Resolution and Mediation
14.1 Complaints
Any complaint must be addressed primarily to Hectolitre's customer service: contact@hectolitre.fr.
14.2 Competent Jurisdiction
In case of failure of mediation, and in the absence of an amicable resolution, any dispute will be submitted to the competent courts in accordance with common law rules. For consumer Customers, this will be, at their choice, the court of their domicile or that of Hectolitre's registered office.
Article 15 — Applicable Law and Language
These GTC are governed by French law. The language of interpretation is French. The public policy protections enjoyed by consumer Customers residing in another European Union Member State are not affected.
Article 16 — Modification of the GTC
Hectolitre reserves the right to modify these GTC at any time. The GTC applicable to an order are those in force on the date the order is placed. The current GTC are permanently accessible on the Site.
